Please read these Terms of Service carefully before using IntentOS. These terms govern your use of our platform and services. By creating an account or using IntentOS, you agree to be bound by these terms.
1. Acceptance of Terms
By accessing or using IntentOS ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you do not have permission to access the Service. These Terms apply to all visitors, users, and others who wish to access or use the Service.
2. Description of Service
IntentOS provides a software-as-a-service platform that enables users to analyze public social media content for competitive intelligence purposes. The Service uses automated tools to collect publicly available data from third-party platforms including TikTok and Instagram, and processes this data using artificial intelligence to generate content insights and recommendations.
3. Accounts
When you create an account with us, you must provide accurate, complete, and current information. You are responsible for safeguarding the password used to access the Service and for any activities or actions under your password. You agree not to disclose your password to any third party. You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.
4. Acceptable Use
You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree not to use the Service: (a) in any way that violates any applicable national or international law or regulation; (b) to transmit, or procure the sending of, any unsolicited or unauthorized advertising or promotional material; (c) to impersonate or attempt to impersonate IntentOS, an IntentOS employee, another user, or any other person or entity; (d) to engage in any conduct that restricts or inhibits anyone's use or enjoyment of the Service.
5. Intellectual Property
The Service and its original content, features, and functionality are and will remain the exclusive property of IntentOS and its licensors. Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of IntentOS. Content generated through the Service using AI tools is provided for your use, but IntentOS retains no ownership claims over user-generated outputs.
6. Third-Party Services
IntentOS uses third-party services including Apify for data collection, Google Gemini for video analysis, and Kimi for content generation. Your use of the Service is also subject to the terms and policies of these third-party providers. IntentOS is not responsible for the practices of these third parties. The collection of publicly available social media data is conducted in accordance with applicable terms of service of the respective platforms.
7. Subscription and Billing
Paid plans are billed in advance on a monthly or annual basis. Subscription fees are non-refundable except as required by applicable law. You may cancel your subscription at any time, and your access will continue until the end of the current billing period. We reserve the right to modify pricing with 30 days' written notice to active subscribers.
8. Limitation of Liability
In no event shall IntentOS, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of (or inability to access or use) the Service.
9. Privacy
Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Service, you consent to the collection and use of information as set out in the Privacy Policy. We take data privacy seriously and never sell your personal data to third parties.
10. Changes to Terms
We reserve the right to modify these Terms at any time. We will provide notice of significant changes by updating the date at the top of this page and, for material changes, by sending an email to the address associated with your account. Your continued use of the Service after changes become effective constitutes acceptance of the revised Terms.
11. Governing Law
These Terms shall be governed and construed in accordance with the laws of the European Union and applicable member state law, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the competent courts.
